Acceptance of Terms

By downloading, installing, or using Then & Now ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms are in addition to Apple's standard End User License Agreement (EULA).

Description of Service

Then & Now is a progress photo tracking application for iOS that allows you to capture, organize, and compare before-and-after photos. The App provides features including photo albums, side-by-side comparisons, slider overlays, timelapse generation, metrics tracking, ghost overlays, voice-guided timers, and private album locking. Data is stored locally on your device with optional iCloud sync.

Auto-Renewable Subscription Terms

  • Payment will be charged to your Apple ID account at confirmation of purchase.
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period at the cost of the chosen plan.
  • You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase.
  • Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
  • Deleting the App from your device does not automatically cancel your subscription. You must cancel through your App Store account settings.
  • You can restore previous purchases by tapping "Restore Purchases" on the subscription screen within the App.

Family Sharing

Then & Now supports Apple Family Sharing for subscriptions. Family members can share access to premium features through a single subscription. Each family member's data remains private. Photos, albums, and metrics are stored individually on each person's device and personal iCloud account.

Free vs Premium Features

Then & Now offers a free tier with limited functionality:

  • Free users have a limited number of photos they can store.
  • Exported images from free accounts include a watermark.

Premium subscribers enjoy unlimited photos, watermark-free exports, and access to all app features including advanced comparison modes, metrics tracking, and private albums.

User Content

You retain full ownership of all photos, data, and content you create within Then & Now. Your content is stored locally on your device and, if enabled, in your personal iCloud account. Mahalo Mochi does not access, collect, or claim any rights to your content.

Intellectual Property

The App, including its design, code, graphics, icons, and overall appearance, is owned by Mahalo Mochi LLC and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App.

Limitation of Liability

Then & Now is provided "as is" without warranties of any kind. Mahalo Mochi LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. This includes, but is not limited to, loss of data, photos, or content. We recommend maintaining backups of important content through iCloud sync or other means.

Termination

You may stop using Then & Now at any time. Deleting the App from your device will remove all locally stored data. To cancel a subscription, manage it through your App Store Account Settings. If you wish to remove iCloud data, disable iCloud sync before deleting the App or manage your data through your iCloud settings.

Apple & Third-Party Terms

These Terms are between you and Mahalo Mochi LLC only, and not with Apple. Mahalo Mochi LLC, not Apple, is solely responsible for Then & Now and its content.

You must comply with any applicable third-party terms when using the App, including your wireless data service agreement.

Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

Changes to Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of the App after changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.
